Compliance requirements

In a joint tender, each joint tenderer is treated as a bidder. The successful bidder, or all joint tenderers if it is a joint tender, must confirm that none of the exclusion grounds in § 95(1) points 1–3 and 5 apply, taking into account § 95(2). The bidder must also confirm that neither the bidder nor any joint tenderer is bankrupt or being liquidated, is subject to bankruptcy or liquidation proceedings, has suspended business, or is in a similar situation under the law of the country of establishment. The bidder must confirm that it has no unpaid state taxes, fees, environmental charges, or tax/social security contribution debts under the law of the country of establishment. The bidder must confirm that its employees’ average wage during the reference period was more than 70% of the average wage for the same period in the relevant field for the contract. The bidder must provide a Tax and Customs Board extract as proof of that wage condition. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered in the construction activity area with the activity types of general construction, indoor climate systems, and water supply or sewerage systems within the building or connected to it. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. For foreign bidders, the registration requirement does not apply, but equivalent proof of competence must be provided where relevant. The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. By the time the construction contract is signed, the bidder must be able to provide a first-demand guarantee letter from a credit or financial institution or an insurance company for 5% of the construction contract value excluding VAT; if the contract is signed before the security is provided, the security must be submitted no later than 10 calendar days after signing. During the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value. An equivalent project means the construction, extension, or full reconstruction of a building and must include at least the construction or reconstruction of load-bearing and external envelope structures, forced ventilation with heat recovery, and a new heating system. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, a person involved in electrical works, and an architect. The project manager must hold at least level 6 construction engineer qualification with a building construction specialisation or level 6 construction manager qualification with a general construction specialisation. The site manager must hold at least level 5 construction foreman qualification with a general construction works specialisation. The ventilation and heating systems specialist must hold at least level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must hold at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification with a specialisation in the construction of internal or connected water supply and sewerage systems. The person involved in electrical works must hold at least a category B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. The architect must be an authorised architect, level 7, or an equivalent foreign professional, responsible for compliance with the European New Bauhaus requirements. The bidder must provide the names and professional or competence certificate numbers of these persons. The bidder must have a quality management system in the field of construction works that complies with at least EVS-EN ISO 9001, and an environmental management system that complies with at least EVS-EN ISO 14001, or equivalent requirements. A copy of the standard or equivalent proof must be submitted for both systems.
