Compliance requirements

The exclusion grounds include at least participation in a criminal organisation, corruption, fraud, and offences related to the commission of a terrorist act or terrorist activity. In the ESPD, the bidder must confirm whether there have been any such final convictions in the last five years or whether any disqualification period set out in the judgment is still in force. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority may also ask for the names and personal identification codes of authorised persons, or confirmation that no such persons exist.

Qualification criteria and exclusion grounds

The bidder’s total net turnover from all business activities for each of the last three completed financial years must be at least EUR 500,000. The ESPD must include the turnover data for the last completed financial years within the three years before the start of the procurement. If the tender is submitted jointly, a power of attorney for the joint bidders must be attached and an authorised representative must be named; the power of attorney must show the lead joint bidder and confirm joint and several liability. The tender must include sample documentation for the charging stations and related infrastructure, as well as Estonian- or English-language documentation proving compliance with the technical specification, including safety and compliance with legal acts, standards or other requirements. The tender must be prepared in Estonian; foreign-language documents must be submitted together with an Estonian translation, except for technical documentation, which may be in English, although the contracting authority may later request a translation. If requested, translations must be provided within 7 working days. The tender price must be submitted according to the structure set out in the compliance conditions. The tender must comply with all requirements in the procurement documents, and conditional tenders are not allowed. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
