Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply to it or any joint bidder, taking into account Section 95(2). The bidder must also confirm that neither it nor any joint bidder is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, suspended from business, or in a similar situation under the law of its country of establishment. In addition, the bidder must confirm that it has no tax, fee, environmental charge, social security contribution or similar debt under the law of its country of establishment. The notice also requires confirmation that the bidder is not a related party to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. These registration requirements do not apply to a foreign bidder, but equivalent proof of competence must be provided where applicable.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means the construction, extension or full reconstruction of a building as the main contractor, and it must have included at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a heating system. To prove this, the bidder must provide the project name, execution period and value, and state whether it was a construction, extension or full-building reconstruction carried out as main contractor. Proof may be a reference to the building register notice of use or occupancy permit number, or a copy of the handover-acceptance act signed by the client and contractor.
The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction, or level 6 construction manager qualification specialising in general construction. The site manager must have at least level 5 construction work supervisor qualification specialising in general construction works. The ventilation and heating systems specialist must have at least level 6 heating, ventilation and cooling engineer qualification with the relevant construction management competences, or level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 water supply and sewerage engineer qualification with construction management competence, or level 6 construction manager qualification specialising in the construction of internal or adjacent water supply and sewerage systems. For electrical works, the involved person must have at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. The bidder must provide the name and qualification or competence certificate number for each of these persons, and they must be involved in the performance of the works.
The bidder must have a quality management system in the construction field complying with EVS-EN ISO 9001 and an environmental management system complying with EVS-EN ISO 14001, or equivalent documented arrangements. If equivalence is relied upon, it must be demonstrated with evidence provided by the bidder.
