Compliance requirements

The successful bidder will be checked for exclusion grounds. The bidder must confirm that neither it nor a joint bidder has the exclusion grounds listed in § 95(1) points 1–3 and 5, taking into account § 95(2). The bidder must also confirm that neither it nor a joint bidder is bankrupt or being liquidated, that no bankruptcy or liquidation proceedings have been opened against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, tax debt or social security contribution debt under the law of its country of establishment. The bidder must confirm that its employees’ average salary during the reference period was more than 70% of the average salary in the same period in the relevant field. This must be proved with a Tax and Customs Board extract. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have a notification for electrical works covering construction of electrical installations, including installation. Foreign bidders may prove equivalent competence with an equivalent document. The bidder’s previous financial year net turnover must be at least twice the estimated contract value, excluding VAT. The bidder must be able to provide a performance security equal to 5% of the contract value by the contract date or within 10 calendar days after signing; the security must remain valid throughout the construction period. A joint bidder may satisfy this requirement jointly. The bidder must have carried out at least one equivalent construction project within the 60 months before the start of the procurement procedure, with a value of at least half of the estimated contract value. The equivalent project must have involved building erection, extension and/or full-building reconstruction as the main contractor, and must have included at least load-bearing and external envelope works, forced ventilation with heat recovery, and heating system construction or reconstruction. The bidder must name a project manager with at least level 6 construction engineer or level 6 construction manager qualification, an object manager with at least level 5 construction work manager qualification, a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification for indoor climate systems, a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification for internal water supply and sewerage systems, and a person involved in electrical works with at least a class B competence certificate or level 6 electrical engineer qualification for consumer electrical installations. Equivalent competence is accepted for foreign bidders. The bidder must also have a quality management system meeting at least EVS-EN ISO 9001 and an environmental management system meeting at least EVS-EN ISO 14001, or equivalent documented conditions. For joint bids, a power of attorney for the joint bidders must be provided. If team members are not the bidder’s employees, written consent for their participation must be attached. The bid must be submitted on the contracting authority’s bid form and must fully accept the tender documents; conditional bids are not allowed. If the bidder relies on equivalence, supporting evidence must be included.
