Compliance requirements

The successful bidder will be checked for exclusion grounds. The bidder must confirm that neither it nor a joint bidder has the exclusion grounds listed in § 95(1) points 1–3 and 5, taking into account § 95(2). The bidder must also confirm that neither it nor a joint bidder is bankrupt or being liquidated, that no bankruptcy or insolvency proceedings have been opened against it, and that its business has not been suspended or is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, social security or similar payment arrears under the law of its country of establishment. The bidder must confirm that its employees’ average salary during the reference period has been more than 70% of the average salary in the same period in the sector relevant to the contract. The bidder must provide a Tax and Customs Board extract as proof of this salary requirement. The bidder must also confirm that it is not a related party to the technical consultant advising the beneficiary on the reconstruction of the apartment building.

Qualification criteria and exclusion grounds

The bidder must have a trade register entry for construction and, where applicable, electrical works, or an equivalent proof for a foreign bidder. In the construction sector, a quality management system compliant with EVS-EN ISO 9001 and an environmental management system compliant with EVS-EN ISO 14001, or equivalent, must be in place. The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT; the exact amount must be entered in the bid to the nearest euro. The bidder must confirm that by the contract date, or within 10 calendar days after it, it can provide a performance security amounting to 5% of the contract value, valid for the entire construction period; a deposit in the beneficiary’s or a notary’s account is also acceptable. Within the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor with a value of at least half of the estimated contract value, and must provide the project name, time, value and proof by occupancy notice, occupancy permit or handover certificate. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works; for each person, the name and certificate or competence number must be provided. The project manager must have at least a level 6 construction engineer qualification with a building construction specialisation or a level 6 construction manager qualification with a general construction specialisation. The site manager must have at least a level 5 construction foreman qualification with a general construction works specialisation. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with a specialisation in internal or associated water supply and sewerage systems. For electrical works, the person involved must have at least a Class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. For a foreign bidder, equivalent competence is acceptable.
