Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons with authority to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion grounds listed in the ESPD. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures, where permitted. The bidder must also confirm that it does not use subcontractors or suppliers for more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the sanctions rule. If subcontracting is used, the required details about subcontractors must be provided and the contracting authority may request documents proving the absence of exclusion grounds. The contracting authority will reject the bid if the sanctions requirement is not met or if a subcontractor is not replaced when required.
Qualification criteria and exclusion grounds
The bidder must have completed, within the 36 months preceding the start of the procurement, at least 4 contracts: 2 Estonian domestic media brokerage service contracts, each worth at least EUR 20,000 excluding VAT, and 2 contracts involving the implementation of advertising campaigns targeted outside Estonia, each worth at least EUR 30,000 excluding VAT. If a contract was still being performed by the bid submission deadline, it is counted only to the extent that the service had been delivered to and accepted by the client by that deadline and had been completed in the required volume. In the ESPD, the bidder must provide a list of these contracts with a short description of the subject matter, contract value, completed volume, area of responsibility, period and the other contracting party’s contact details; for public procurement contracts, the reference number must also be included. The bid must comply with the procurement documents, conditional bids are not allowed, and where relevant the bidder must explain equivalence and attach proof. If subcontractors are used, the bidder must provide the required details about them and, if necessary, replace any subcontractor for whom an exclusion ground exists. In the case of a joint bid, a power of attorney for the joint bidders must be attached. The bid price must be submitted in the required structure, with unit prices in euros excluding VAT and zero or negative values are not allowed.
