Compliance requirements
The bidder must be excluded if the bidder or its management, supervisory body member, procurator or other authorised representative has any of the grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment of a foreign national or violating the conditions for employing a foreign national; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the country of establishment; or a breach of an international sanction or a sanction imposed by the Government of the Republic. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment if required by the law of that country, and must provide evidence of registration if the information is not publicly available to the contracting authority. The total annual net turnover for each of the last three completed financial years must be at least EUR 140,000 per year; for Estonian bidders, the contracting authority may check turnover from public databases, but extracts from the last three annual reports may be required if needed. If the bidder has been operating for less than three years, the requirement is assessed only for the period of existence. For the financial requirement, the bidder may rely on the resources of other undertakings if both parties sign a declaration. The bidder or its subcontractor must have performed at least one similar contract in the last 36 months, with the subject being outdoor cleaning services such as street cleaning, street sweeping, car park cleaning, snow removal, ice removal, waste-related services, or planting and maintenance of green areas. A list of contracts must be submitted, including the contract name, short description, performance period and the other contracting party. If the bidder relies on a subcontractor’s reference, the subcontractor must also be added to the subcontractor table. The bid must also include the forms and confirmations required by the tender documents and must comply with all tender document conditions.
