Compliance requirements
The bidder must not be bankrupt or in liquidation, must not be subject to bankruptcy or liquidation proceedings, and its business must not be suspended. The bidder must also have no tax, fee or environmental charge debt, and no tax or social security contribution debt, unless the debt has been deferred, paid, or will be paid/deferred within 10 calendar days after notice.
The bidder must not fall under the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act, taking Section 95(2) into account. If the absence of exclusion grounds cannot be checked in public registers, supporting evidence must be submitted. A foreign bidder must provide evidence from an equivalent authority in its country of establishment. The bidder must also not be a related person to the technical consultant advising the contracting authority on the apartment building reconstruction. If the required evidence is not submitted within 10 calendar days, the bidder may be excluded from the procurement.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, building indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. This registration requirement does not apply to foreign bidders, who may prove competence with an equivalent certificate.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. If the bidder’s financial year is the calendar year, the relevant year is 2024.
The bidder must be able to provide a performance security amounting to 5% of the contract value no later than on the contract signing date or within 10 calendar days after signing. The security must remain valid throughout the construction period. A deposit of the corresponding amount into the contracting authority’s bank account or a notary account is also acceptable, provided the contracting authority remains the beneficiary throughout the construction period.
Within the last 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the construction, extension or full reconstruction of a building as the main contractor, and it must have included at least construction or reconstruction of the load-bearing structure and external envelope, construction or reconstruction of a heat-recovery ventilation system, or construction or reconstruction of a new heating system. The bidder must provide the project name, building details, execution period and value, and proof in the form of a reference to the building register occupancy notice or building permit number, or a copy of the handover-acceptance certificate.
The bidder’s team must include a project manager with at least level 6 construction engineer qualification in building construction with the relevant specialization, or level 6 construction manager qualification in general construction; for a foreign bidder, an equivalent qualification is acceptable. The notice also indicates that an object/site manager, a ventilation specialist, a water supply and sewerage specialist, and a competent electrical works person are part of the required team where applicable. The exact team composition and proof requirements must be checked in the tender documents.
