Compliance requirements

The bidder must confirm the standard exclusion grounds in the ESPD, including no final convictions in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences and related crimes, as well as the other mandatory exclusion grounds listed in the tender documents. If an exclusion ground exists, the bidder may provide evidence of self-cleaning where allowed. The notice also requires confirmation that the bidder does not involve subcontractors or suppliers exceeding 10% of the contract value who are Russian citizens, residents, entities established in the Russian Federation, entities more than 50% owned by such persons or entities, or representatives acting on their instructions. The contracting authority will reject a tender if the resulting contract would be void under the sanctions rules. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.

Qualification criteria and exclusion grounds

The machine-readable notice included a financial qualification requirement: the bidder’s net annual turnover for each of the last 5 financial years ending before the start of the procurement must be at least EUR 100,000, i.e. EUR 500,000 in total. The successful bidder must submit extracts from the last 5 annual reports showing the turnover, unless the data are publicly available to the contracting authority from a register. The notice also requires the bidder to complete the tender price form in the specified structure and to state the delivery times for the listed items. For suits and helmets the maximum delivery time is 4 months from receipt of the order; for gloves, balaclavas and body protectors it is up to 2 months; for boots it is 4 months. Helmets must have a warranty of at least 2 years and visors at least 1 year from handover. The exact compliance and document requirements must be checked in the tender documents.
