Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, authorised signatories or other persons with power to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The tender documents also include a sanctions-related confirmation concerning subcontractors and suppliers: the bidder must confirm that it does not involve subcontractors or suppliers exceeding 10% of the contract value if they are citizens of the Russian Federation, residents of the Russian Federation, or undertakings established in Russia, or persons/entities connected to them.
Qualification criteria and exclusion grounds
The bidder must submit the ESPD and confirm that the tender complies with the procurement documents. The financial capacity requirement is explicit: during the last 5 financial years, the bidder’s annual net turnover must have been at least EUR 100,000 in each year, totalling at least EUR 500,000, and the successful bidder must provide extracts from the last 5 annual reports if the data are not publicly available to the contracting authority. The compliance requirements include completing the price form and providing the required pricing structure. The bidder must also state delivery times in months for driving suits, helmets, gloves, body protectors, boots and balaclavas, and confirm that delivery costs for all listed items are included in the tender price. Helmets must have a warranty of at least 2 years and visors a warranty of 1 year; the bidder must state the offered warranty period in years. If the bid is a joint bid, a power of attorney for the joint bidders must be attached. The bid must be unconditional, comply with the procurement documents, and, where necessary, include evidence of equivalence.
