Compliance requirements
In the case of a joint tender, the exclusion grounds are checked separately for each joint bidder. The bidder must confirm that neither it nor any joint bidder is subject to the exclusion grounds listed in Section 95(1)(1)–(3) and (5) of the Public Procurement Act, taking into account Section 95(2). The bidder must also confirm that neither it nor any joint bidder is bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against them, and that their business activities have not been suspended. In addition, the bidder must have no outstanding state tax, fee or environmental charge debts, and no tax or social security contribution debts under the law of the country of establishment. The bidder must also confirm that the average salary of its employees during the reference period was more than 70% of the average salary for the same period in the sector relevant to the contract subject, and this must be evidenced if necessary by an extract from the Tax and Customs Board. Finally, the bidder must confirm that it is not a related party to the technical consultant advising the beneficiary on the reconstruction of the apartment building.
The machine-readable notice did not include any more precise exclusion grounds; they must be checked in the official tender documents or tender documents if needed.
Qualification criteria and exclusion grounds
The bidder must be registered in the Economic Activities Register for construction activities covering general construction, indoor climate systems, and water supply or sewerage systems inside or attached to the building. This registration requirement does not apply to a foreign bidder; in that case, equivalent proof of competence must be provided.
For electrical works, the bidder must have notified the Economic Activities Register under the activity "Electrical works" for construction and installation of electrical installations. This registration requirement does not apply to a foreign bidder; in that case, equivalent proof of competence must be provided.
The bidder's net turnover for the financial year preceding the submission of the tender must be at least equal to twice the expected value of the contract, excluding VAT. The exact amount must be entered in euros.
By submitting a tender, the bidder confirms that it can provide, by the latest on the date the construction contract is signed, a first-demand guarantee letter issued by a credit institution, financial institution or insurance company in the amount of 5% of the construction contract value excluding VAT. If the contract is signed before the guarantee is provided, the bidder must submit it within 10 calendar days after signing. The guarantee must remain valid for the entire construction period. A deposit of the corresponding amount to the beneficiary's bank account or notary account is also accepted, provided the beneficiary remains the entitled party throughout the construction period. Joint bidders may satisfy this requirement together.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction work with a value of at least half of the expected contract value. Equivalent work means construction of a building, extension of a building, or full-building reconstruction as the main contractor, including at least construction or reconstruction of the load-bearing and external envelope structures, construction or reconstruction of mechanical ventilation with heat recovery, and construction or reconstruction of a new heating system. The bidder must provide the name of the work, the time of performance, the value, whether it was construction, extension or full reconstruction as main contractor, and evidence such as a reference to the building register notice or use permit number, or a copy of the handover-acceptance act signed by the client and contractor.
The bidder's team must include a project manager with at least level 6 construction engineer qualification specialising in building construction and construction management competence, or level 6 construction manager qualification specialising in general construction. A foreign bidder may provide a person with equivalent competence.
The bidder's team must include a site manager with at least level 5 construction work manager qualification specialising in general construction works. A foreign bidder may provide a person with equivalent competence.
The bidder's team must include a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification with competence in managing construction of heating systems and ventilation systems, or level 6 construction manager qualification specialising in indoor climate systems. A foreign bidder may provide a person with equivalent competence.
The bidder's team must include a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification with competence in construction management, or level 6 construction manager qualification specialising in the construction of internal or building-related water supply and sewerage systems. A foreign bidder may provide a person with equivalent competence.
For electrical works, the bidder's team must include a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. A foreign bidder may provide a person with equivalent competence.
The bidder's team must include an authorised architect at level 7, or a person with equivalent competence from another country, who is responsible for ensuring that the construction project complies with the European New Bauhaus requirements.
The bidder must have an implemented quality management system in the field of construction works that complies at least with EVS-EN ISO 9001 or equivalent requirements.
