Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members have been convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, use of child labour or other forms of human trafficking, terrorist offences, or any other exclusion grounds listed in the ESPD. The bidder must also confirm that it will not use subcontractors or suppliers representing more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the sanctions rules, and that it will not use subcontractors that must be replaced under Section 122(7) of the Estonian Public Procurement Act. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and confirmations must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must show an average net turnover of at least EUR 100,000 in the area related to the subject matter of the contract over the last three completed financial years. In a joint bid, compliance may be demonstrated by combining the figures of all joint bidders. The bidder must also have performed at least one contract during the 36 months before the start of the procurement under which a substance was spread from an aircraft. For this reference, the bidder must provide the client’s name and contact details, contract performance dates, contract value and a description of the contract subject. The bid must also include the documents required in technical specification points 7.1–7.4: for EASA aircraft, a declaration on SPO flights, confirmation of receipt from the competent authority, the airline’s risk assessment and, if applicable, a permit for high-risk commercial special flights; for non-EASA aircraft, an operating permit for special flights; copies of the aircraft register, airworthiness and insurance documents; and valid commercial pilot licences or airline transport pilot licences for the pilots. The bid must comply with all tender document requirements, and conditional bids are not allowed.
