Compliance requirements
The tender documents set out mandatory exclusion grounds based on criminal convictions, including participation in a criminal organisation, corruption, fraud and other grounds listed in the ESPD. The bidder must answer the exclusion questions, and where applicable may provide evidence of self-cleaning. The notice also requires confirmation regarding tax and social security payments and, where relevant, electronic availability of the information.
Qualification criteria and exclusion grounds
The bidder must confirm that the bid complies with all tender documents. The bidder must submit the completed bid form, technical information material and the packaging label for each offered product; for medical devices, also the instructions for use, the manufacturer’s declaration of conformity and, where applicable, the EC certificate. The price must be submitted in the required structure together with the completed price form. If equivalence is relied on, the bidder must explain it and provide evidence. In a joint bid, a power of attorney for the joint bidders must be attached. The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents.
