Compliance requirements

The tender documents include the standard exclusion grounds under the Estonian Public Procurement Act, in particular participation in a criminal organisation, corruption, fraud and other mandatory criminal-conviction grounds. The bidder must answer the exclusion questions in the ESPD and, where applicable, provide evidence of self-cleaning. The machine-readable notice did not include the full list of all exclusion grounds; they must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must submit the ESPD and confirm that it has the right to sell the offered products in Estonia. If the manufacturer is not established in the European Union, the bidder must provide the document, or a copy of the document, proving the authorisation granted by the manufacturer’s authorised representative; in case of sub-delegation, the relevant additional documents must also be provided. The bidder must employ, or otherwise engage on a contractual basis, a product representative for the offered products who has been trained by the manufacturer or has completed training for the products covered by the tender. On the contracting authority’s request, copies of certificates proving the training, or the manufacturer’s written confirmation of the training, must be submitted. The tender must comply with the technical requirements. Annex 1 must be submitted in Excel format and must show the exact product name, manufacturer, product code or reference number, descriptions of all sub-sections and the actual parameters. Prices must be given in euros to two decimal places, by lot and separately for each product as well as as a total amount. The price must also include delivery, unloading and the provision of any relevant training at the Tartu University Hospital pharmacy or warehouse. The bidder must also submit the declaration in Annex 3 Form II and the technical specification in Annex 1. In the case of a joint tender, a power of attorney for the joint bidders and a confirmation of joint and several liability must be submitted in Annex 3 Form I. The bidder must also confirm compliance with the tender documents, the marking and justification of trade secrets, compliance with sanctions requirements, and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
