The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or offences related to terrorist acts or terrorist activities, and that the relevant exclusion grounds do not still apply. The bidder must also confirm that it is not a sanctioned entity and that it does not use subcontractors or suppliers accounting for more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the regulation. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted. The machine-readable notice did not include all precise exclusion grounds; they must be checked in the tender documents.

The bidder must have completed or currently be performing at least 3 similar rental contracts for lifting equipment within the last 36 months. In the ESPD, the bidder must provide details of the main contracts, including their value, dates and the other contracting parties. The person submitting the bid must be the bidder’s legal representative or must attach a document proving the authority of an authorised representative. In the case of a joint bid, the joint bidders’ representative must be named, a power of attorney must be attached, and the share and role of each joint bidder must be described. The bid must comply with the tender documents; conditional bids are not allowed; and equivalence evidence must be provided where necessary. The vehicle requirements and bid form must be completed with all required rows and columns.
