Compliance requirements
As an exclusion ground, tenderers originating from third countries are not allowed to participate. A third country means a country that is not an EU Member State, an EEA country, a party to the WTO Government Procurement Agreement, or a country with which the European Union has concluded a reciprocal free trade agreement covering public procurement.
The bidder must state its country of origin, meaning the country where the company is registered. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s annual sales revenue for each of the last 3 financial years must be at least EUR 5,000,000 per year. If the bidder is not an Estonian company, it must be prepared to provide a signed copy of its financial statements or similar documents to confirm this.
Within the last 60 months before the start of the procurement, the bidder must have delivered at least one sponge-cake production line to clients. The delivered line must include batter and cream preparation, depositing/extrusion, cutting and decorating. The bidder must provide the client’s name and contact details, a short description of the delivered line, and the month and year of acceptance of the works.
To demonstrate technical compliance, the bidder must submit the technical requirements form, technical specifications and, if necessary, drawings and manufacturer details of the main components. A declaration of compliance must also be submitted to confirm that the equipment meets the minimum requirements of Regulations 1935/2004, 2023/2006 and (EU) 10/2011.
If the bid is a joint tender, a power of attorney from the joint bidders must be included. The bid must comply with all tender document requirements, and conditional bids are not permitted. If equivalent solutions are offered, equivalence must be explained and supporting evidence attached.
