Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering, financing of terrorism, illegal use of child labour, or human trafficking. Exclusion also applies where the bidder has tax, fee or environmental charge arrears, social security contribution arrears, or where the award of the contract would breach sanctions. The bidder must confirm compliance with the exclusion grounds.
Qualification criteria and exclusion grounds
For Lots 1 and 2, the bidder must have properly completed at least two similar construction works during the 60 months preceding the start of the procurement. For Lot 1, similar work means earthworks and surfacing works for a public road or square with an area of at least 300 m2. For Lot 2, similar work means the construction of a public ball game court. In both cases, the works must have been carried out in accordance with the signed contracts and good construction practice, and they must have been completed and accepted by the client. The bidder must provide information on the location of the works, the time when they were carried out, and the clients. To meet the compliance requirements, the bidder must also submit Form VI price table, a joint bidders’ power of attorney if applicable, a power of attorney for a legal entity bidder if needed, confirmation of compliance with the tender, confirmation that suitably qualified staff will be used, the required subcontracting forms if subcontractors are used, and the details of authorised representatives if they are not visible in the business register.
