Compliance requirements

The machine-readable notice includes the usual exclusion grounds for criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, terrorism-related offences, and similar mandatory exclusion grounds. The bidder and its management, administrative or supervisory bodies, and authorised representatives must not have final convictions that trigger exclusion within the relevant period. If an exclusion ground exists, the bidder may, where allowed, submit evidence of self-cleaning. The exact wording and all applicable exclusion grounds must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must have had annual net turnover of at least EUR 500,000 in each of the last three financial years and must provide extracts from the financial statements for those years. If the bidder relies on another company’s resources, both companies must be jointly liable for the part of the contract covered by those resources. The bidder must have experience from the last 60 months in road and street construction. At least one properly completed contract must cover public roads and streets in a volume of at least 4,000 m². The bidder must provide a short description of the contracts, the performance period, the other party’s contact details, and, for public procurements, the reference numbers. On request, proof of proper performance must be submitted. The bidder must name the responsible specialist for the works, i.e. the site manager, who must hold a road engineer professional certificate, level 6, in the field of management of construction activities, or an equivalent qualification. If the bidder relies on another company’s resources for this requirement, the other company must also be free of the relevant exclusion grounds and the supporting ESPD must be signed by an authorised person of that company. The bid must be unconditional and must comply with the tender documents. The bidder must submit the price breakdown in the structure required in the tender documents, the joint bidders’ power of attorney if applicable, and the confirmation that the bid meets the tender documents. The bidder must also confirm that no subcontractor subject to replacement under the law will be used. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. The bidder must confirm that the bidder’s place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
