Compliance requirements

The bidder must confirm that none of the statutory exclusion grounds apply, including the grounds listed in section 95(1) points 1–3 and 5 of the Public Procurement Act, insolvency or liquidation, suspension of business, and tax, fee or social security contribution debts under the law of the bidder’s country of establishment. The bidder must also confirm that its average wage during the reference period was more than 70% of the average wage in the relevant sector for the same period, and must provide proof from the Tax and Customs Board or an equivalent authority for a foreign bidder. In a joint bid, proof must be submitted for each joint bidder. The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. The machine-readable notice did not include any more precise exclusion-ground requirements; these must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or adjoining water supply and sewerage systems. For electrical works, the bidder must also have a business activity notice for electrical works covering construction and installation of electrical installations; this registration requirement does not apply to a foreign bidder, which may prove equivalent competence instead. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value, excluding VAT. In a joint bid, this requirement may be met by one joint bidder alone; turnover may not be aggregated. The bidder must have completed at least one equivalent construction project during the 60 months before the start of the procurement procedure. The project must be worth at least half of the expected contract value excluding VAT and must have involved as main contractor the construction, extension, or full-building reconstruction of a building, including at least structural and external envelope works, heat-recovery ventilation works, and a new heating system. The team must include a project manager with at least level 6 construction engineer or level 6 construction manager qualification, a site manager with at least level 5 construction supervisor qualification, a ventilation and heating specialist with at least level 6 heating, ventilation and cooling engineer qualification or equivalent, a water supply and sewerage specialist with at least level 6 water supply and sewerage engineer qualification or equivalent, and a person involved in electrical works with at least a B-class competence certificate or level 6 electrical engineer qualification for consumer electrical installations. Foreign bidders may prove equivalent competence. The bidder must have a quality management system for construction works meeting at least EVS-EN ISO 9001 or equivalent requirements, and an environmental management system for construction works meeting at least EVS-EN ISO 14001 or equivalent requirements. The notice also requires the bidder to submit the names and certificate numbers of the relevant team members and, where applicable, copies of the standards or equivalent proof.
