Compliance requirements
The bidder must confirm that neither it nor the members of its management or supervisory bodies have been convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, human trafficking, child labour or other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have previous experience in selling boots and/or boot covers: within the last 36 months, at least one contract or order with a total value of at least EUR 250,000 excluding VAT must have been properly performed. The bid must include the details of the completed contract(s) or order(s), including description, amount, period, buyer name and contact details. The contracting authority may request written confirmation from the other contracting party within at least 5 working days. If the bidder relies on the capacities of another entity, that entity’s ESPD must also be submitted together with confirmation that it has no exclusion grounds and agrees to the reliance. The bid must comply with the tender documents, and equivalence must be explained where necessary with supporting evidence. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. In addition, entities from the Russian Federation, residents of the Russian Federation, or businesses established in the Russian Federation, or persons controlled by them, may not be involved in more than 10% of the contract value.
