Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members have been convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The bidder must also confirm that taxes and social security contributions have been paid, or that the information is electronically available. The contracting authority may reject the bid if the sanctions requirements are not met or if the contract would be void because of sanctions rules.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. However, the bid must include the required form ‘Annex 3. Specification and price form for the offered goods’ and all blue-marked fields must be completed. The offered goods must comply with the technical specification. If the bid is signed by an authorised representative, a power of attorney must be attached. In the case of a joint bid, an authorised representative must be appointed. The bid must also confirm compliance with the tender documents and, where relevant, that equivalence has been explained and supporting evidence attached.
