Compliance requirements

The bidder is excluded if it or any undertaking whose resources it relies on for qualification has exclusion grounds under Section 95(1) of the Public Procurement Act. The contracting authority may also exclude the bidder if there has been a breach of previous public contracts or if false information has been provided about compliance with qualification conditions, or if such information has been omitted. The bidder must also confirm that neither it nor any relied-upon undertaking is established in the Russian Federation or the Republic of Belarus. If the answer is ‘no’, the relevant exclusion ground or breach must be described.

Qualification criteria and exclusion grounds

The bidder must hold a security activity licence under Section 12 of the Security Activities Act, or an exemption from it; reliance on another undertaking’s licence is not allowed. The net turnover for each of the last three completed financial years must be at least EUR 800,000, and these figures must be provided in Form 1. The bidder must have performed, within the 36 months before the publication date of the contract notice, at least one guarding services contract covering both manned and technical guarding, under which the service was provided at least on one site for at least 12 consecutive months; contract details must be provided in Form 1. The bidder must have a quality management system implemented in the security services field that meets at least ISO 9001 or an equivalent requirement; if needed, a copy of the certificate or a confirmation from an independent audit firm or accredited certifier must be submitted. For the performance of the guarding service, the bidder must involve a project manager who holds the professional certificate Security Manager, level 5, or an equivalent qualification, and has at least 3 years of relevant experience in the security services field during the last five years. The project manager’s experience must be evidenced by a CV and, where applicable, by the client’s confirmation, a contract or a contract document; if the qualification certificate was issued outside Estonia, documents proving equivalence must also be submitted. Form 6 and, where applicable, subcontractor information must also be submitted with the bid.
