Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1)–(3) and (5) of the Public Procurement Act apply, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been initiated against it, that its business has not been suspended, and that it has no outstanding tax, fee, environmental charge or social security contribution debts under the law of its country of establishment. In addition, the bidder must confirm that the average salary of its employees during the reference period was above 70% of the average salary for the same period in the relevant field for the contract subject matter, and must submit an extract from the Tax and Customs Board or, for a foreign bidder, an equivalent certificate from a competent authority. The bidder must also confirm that it is not a related person to the technical consultant advising the contracting authority on the renovation of the apartment building. In a joint bid, the exclusion grounds are checked for each joint bidder separately.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a registration notice for electrical works covering the construction, including installation, of electrical installations; this registration requirement does not apply to a foreign bidder, but the foreign bidder must prove equivalent competence. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, at least one joint bidder must meet this requirement on its own. The bidder must provide details of at least one equivalent construction project completed within the last 60 months. The equivalent project must have a value of at least half of the estimated contract value excluding VAT. It is considered equivalent if it involved the construction, extension or full-building reconstruction of a building as the main contractor, and included at least the construction or reconstruction of the load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a new heating system. The bidder must provide the project name, building details, execution time and value, and information on the scope of the works. The team must include a project manager with at least level 6 construction engineer qualification in building construction or level 6 construction manager qualification in general construction. The site manager must have at least level 5 construction foreman qualification specialising in general construction works. The ventilation and heating systems specialist must have at least level 6 heating, ventilation and cooling engineer qualification with the relevant construction management competences, or level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification specialising in the construction of internal or building-related water supply and sewerage systems. The person involved in electrical works must have at least a Class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. The bidder must have a quality management system in the field of construction works that complies with at least EVS-EN ISO 9001, and an environmental management system that complies with at least EVS-EN ISO 14001, or equivalent requirements. A copy of the standard or proof of equivalence must be submitted.
