Compliance requirements
An exclusion ground is participation in a criminal organisation: if the bidder itself, or a member of its management, administrative or supervisory body, or a person with authority to represent it, make decisions on its behalf or control it, has been finally convicted of such an offence within the last five years, or if the disqualification period in the judgment is still in force, this may lead to exclusion. The ESPD requires an answer on this point, and the bidder may, where applicable, submit evidence of self-cleaning measures. The machine-readable notice did not include other precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment. In the ESPD, the bidder must confirm the registration and, if requested by the contracting authority, provide the registration number, register details and evidence of registration. If the bid is submitted as a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bid must comply with the conditions set out in the procurement documents, and where necessary equivalence must be explained and supporting evidence provided. The bid price must be submitted in the structure required by the contracting authority. If the machine-readable notice does not fully show the exact technical or other qualification requirements, they must be checked in the tender documents.
