Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been initiated against it, if its business activity has been suspended, or if it is in a similar situation. Exclusion also applies if the bidder has unpaid state taxes, fees, environmental charges or social security contributions, unless the debt has been deferred, paid, or will be paid/deferred within 10 calendar days after receiving the notice.
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking Section 95(2) into account. If the contracting authority cannot verify this from public registers, it may request evidence issued no more than two weeks before the deadline for submitting tenders.
The bidder must also confirm that its average employee salary during the reference period was above 70% of the average salary in the same period in the relevant field for the contract subject. If the bidder has no employees, this requirement does not apply. A foreign bidder must provide equivalent certificates from its home country.
The bidder and the technical consultant advising on the apartment building reconstruction must not be related persons. If the required evidence is not submitted and the check cannot be made from public registers, the bidder is given 10 calendar days to remedy the deficiency; after that, the bidder is excluded.
Qualification criteria and exclusion grounds
The bidder must have filed in the Estonian business register a construction activity notice covering general building works, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have an electrical activity notice for construction, including installation, of electrical installations. For foreign bidders, the register entry requirement does not apply, but equivalent proof of competence must be provided if needed.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value, excluding VAT. The exact amount must be entered to the nearest euro.
The bidder must accept the condition that by the contract date, or within 10 calendar days after contract signature, it must be able to provide a bank-confirmed performance security equal to 5% of the contract value. The security must remain valid throughout the construction period; depositing the corresponding amount into the contracting authority’s bank account or a notary account is also accepted if the contracting authority remains the beneficiary throughout the construction period.
Within the last 60 months before the start of the procurement procedure, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means the construction, extension or full-building reconstruction of a building as the main contractor, including at least the construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and heating system works. The bidder must provide the project name, timing, value, information on the main contractor role, and proof by reference to the handover-acceptance certificate or the building register notice/occupancy permit.
The bidder’s team must include a project manager with at least level 6 construction engineer qualification specialising in building construction and competence in managing construction activities, or a level 6 construction manager qualification specialising in general building works. For a foreign bidder, equivalent competence is accepted. The relevant person must be involved in the execution of the works. The project manager’s name and professional certificate number must be provided.
