Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurists or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. For subcontractors, the bidder must confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must provide references for at least 3 similar contracts performed within the last 36 months before the start of the procurement procedure. A similar contract means a contract lasting at least 3 months for the development and/or modernisation/modification of information and communication systems, with a contract value of at least EUR 50,000. Successful performance means that the contracting authority signed the final acceptance certificate or, if no such certificate exists, the final deliverables were handed over and accepted.
The bidder’s total turnover for the last three financial years must be at least EUR 160,000.
The bid must include a completed application form and, where applicable, a power of attorney for joint bidders. If the bidder wants to score quality points under the award criterion “Implementation Plan”, it must submit a technical proposal describing the technology stack and project implementation architecture in line with the technical requirements. The bid must comply with the tender documents and conditional bids are not allowed. If equivalent solutions are used, the bidder must explain equivalence and attach supporting evidence.
