Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and other offences and situations listed in the ESPD. The bidder must confirm that neither it nor its management board members, procurists or other persons with authority to represent it have been finally convicted for these grounds within the last five years, or that the exclusion period no longer applies. If a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The tender documents also include a sanctions-related confirmation concerning subcontractors and suppliers.
Qualification criteria and exclusion grounds
The bidder’s net turnover in the field of information system development (EMTAK 62011 or equivalent) for each of the last three financial years must be at least EUR 250,000 per year; in total this means at least EUR 750,000 over three years. The bidder must have properly performed at least three software development contracts during the 36 months preceding the start of the procurement, each with a value of at least EUR 180,000 excluding VAT. Ongoing contracts may also be counted if, during the last 36 months, work worth at least EUR 180,000 excluding VAT was carried out and accepted by the client. The bidder must provide details of at least three reference contracts, and the contracting authority may verify them from the successful bidder and, if necessary, from the other contracting party. As compliance conditions, the bidder must confirm that the tender complies with the procurement documents, that conditional tenders are not allowed, that a joint tender requires a joint bidders’ power of attorney, and that the tender price must be submitted in the required structure. The team must include competencies in project management, analysis, user experience design, user interface design, frontend development, backend development and testing; one person may cover multiple roles, but the developer and tester roles may not be performed by the same person. The bidder must also submit the contracting authority’s team CV form and a project plan. In addition, the bidder must confirm compliance with the EU sanctions requirement: subcontractors and suppliers representing more than 10% of the contract value may not be Russian citizens, Russian residents or entities established in Russia, entities more than 50% owned by them, or persons acting as their representatives or under their instructions.
