The tenderer must not be excluded on the mandatory exclusion grounds set out in the tender documents, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour and other forms of trafficking in human beings, and other grounds referred to in the procurement documents. The tenderer may have to confirm that no such grounds apply and, where relevant, that self-cleaning measures have been taken. The machine-readable notice did not include the full list in a structured form; the exact exclusion grounds must be checked in the official tender documents.

The tenderer must be a law firm within the meaning of Section 49 of the Bar Association Act and must be included in the list of law firms maintained by the Estonian Bar Association. The tenderer must be able to provide legal services in all fields named in Annex 1, point 2.1, and for each field there must be a legal expert who is a member of the Estonian Bar Association. The team must include at least one lawyer holding a sworn advocate’s professional certificate, and the tenderer must provide that person’s name. Taken together, the team members must be authors or co-authors of at least three professional publications on the fields or topics listed in Annex 1, points 2.1.6–2.1.8 and 2.1.12, published within the last 36 months in nationally distributed periodicals or international publications. The tenderer must provide details of contracts performed during the 36 months before the start of the procurement. The total value of contracts in the relevant fields must be at least EUR 30,000 excluding VAT. At minimum, the contract name and topic, contract value, client contact details, and start and end dates must be provided. At least 4 completed assignments are required. The machine-readable notice did not include any more precise qualification or compliance requirements; the remaining requirements must be checked in the official tender documents.
