Compliance requirements

The bidder must confirm that neither it nor the members of its management, representation or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or offences related to a terrorist act or terrorist activity. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not include precise exclusion grounds; these must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must have properly performed at least 3 contracts similar to the subject of the procurement within the last 36 months. A similar contract is a sale and maintenance contract for an arthroscope, mammograph or ultrasound device; for a maintenance contract, the requirement is also met if the contract is still being performed at the time of submission. A short description of the contracts, their value, performance period, other contracting parties and, for public procurements, reference numbers must be provided. Upon request, the contracting authority must be given evidence that the contracts were performed properly. The team must include at least one medical technology maintenance engineer who has received manufacturer training for servicing and repairing the offered devices and who has at least 2 years of experience maintaining similar devices in Estonia. The tender must comply with the technical specification and include the device name, manufacturer, model, technical description, manufacturer’s official technical documentation, a price breakdown table and a description of maintenance needs for 7 years. In the case of a joint tender, a power of attorney from the joint bidders must be attached. The bidder must also confirm that the tender complies with the procurement documents, that the tender price is submitted in the required structure, that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. It must also confirm that subcontractors or suppliers linked to the Russian Federation and accounting for more than 10% of the contract value are not involved.
