Compliance requirements
The bidder must submit a confirmation of the absence of exclusion grounds on the HD Annex 5 form. In a joint bid, all joint bidders must submit the confirmations and complete the fields relevant to their situation. The exclusion grounds include, among other things, convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; violations related to illegal employment of foreign workers; convictions for illegal use of child labour or human trafficking; tax debt or social security contribution debt; and any situation where concluding the contract would breach an international sanction or a sanction of the Government of the Republic. The contracting authority may also exclude a bidder if it has previously seriously breached a contract, submitted false information, or violated environmental, social or labour-law obligations.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU, EEA or WTO GPA member state, if required by the laws of the bidder’s country of establishment. An Estonian bidder does not need to submit a copy of the registration certificate. If the bidder relies on the capacities of another company, it must provide both the details of the relied-on entity and that entity’s confirmations on the HD Annex 5.1 form. The bidder’s net turnover for each of the last three completed financial years before the start of the procurement (2023, 2024, 2025) must be at least EUR 200,000 excluding VAT per year; the information must be provided on the HD Annex 5 form and, on request, supported by an extract from the annual accounts or other evidence. During the 36 months preceding the launch of the procurement, the bidder must have completed at least 2 Microsoft SharePoint development contracts, each worth at least EUR 10,000 excluding VAT; the work must have been accepted and without material breaches. An ongoing contract may also qualify if these conditions are met. A framework agreement itself cannot be used as a reference, but a contract concluded under a framework agreement may qualify if it meets the requirements. The bidder must have at least a 2-member team: at least 1 project manager and at least 1 developer. The project manager must have participated as a project manager in at least 2 Microsoft SharePoint software development projects during the last 36 months; the developer must have participated as a developer in at least 2 such projects during the same period. Experience may come from employment or a reference contract and may also be ongoing if the minimum scope is met. The bidder must submit the team list on HD Annex 7 and the CVs or other details of the project manager and developer on HD Annex 7.1 and HD Annex 7.2. The bidder must be a Microsoft SharePoint development partner in Estonia; compliance must be verifiable on Microsoft’s partner page or by a manufacturer’s confirmation letter. The tender must comply with the procurement documents and conditional tenders are not allowed. In a joint bid, a power of attorney on HD Annex 4 must be submitted. If the bidder relies on another entity’s capacities, that entity’s confirmations on HD Annex 5.1 must also be provided.
