Compliance requirements
The exclusion grounds include the usual criminal-conviction-related grounds: participation in a criminal organisation, corruption, money laundering or terrorist financing, use of child labour and other forms of human trafficking, commission of a terrorist act or offences related to terrorist activity, and other grounds listed in the ESPD. The bidder must confirm, where required, that none of these grounds apply and may in some cases submit evidence of self-cleaning or restored reliability. If the information is electronically available, it must also be provided. The exact exclusion grounds and any possible evidence must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the registration itself; a foreign bidder must submit a register extract or other proof on request if the registration cannot be verified from a public database. The financial capacity requirement is that the net turnover for each of the last financial years ended by the start of the last three public procurements must be at least EUR 1,500,000 per year. As regards technical and professional capacity, the bidder or joint bidder must have at least a construction works project manager and a construction works site manager; both must have at least construction engineer level 6, specialisation in building construction, occupation in construction management, or an equivalent qualification under the EQF or an equivalent occupational standards system. The project manager and site manager may be the same person, but in that case the person must meet the project manager requirements. The bidder must provide the names of the specialists and other information required in the ESPD, and the successful bidder must, if necessary, submit copies of professional certificates or equivalent documents. The tender must comply with all tender document requirements, and conditional tenders are not allowed. In the case of a joint tender, a power of attorney from the joint bidders must be submitted. It must also be confirmed that, where applicable, equivalence has been explained and supporting evidence has been attached.
