Compliance requirements

The bidder must confirm that neither it nor its management, supervisory or representative persons have been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering, terrorist financing, child labour or human trafficking. There must also be no tax debt and no breach of sanctions. The contracting authority may also exclude a bidder for serious prior breach of a contract or for submitting false information. In a joint tender, all joint bidders must provide the confirmations. The exact confirmations must be submitted on the HD Annex 5 form.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of an EU, EEA or WTO GPA member state, if required by the laws of the bidder’s country of establishment. If the bidder relies on the capacities of another entity, it must provide details of that entity and that entity’s confirmations on the HD Annex 5.1 form. Net turnover for each of the last three completed financial years before the start of the procurement (2023, 2024, 2025) must have been at least EUR 150,000 excluding VAT in each year; if the financial year is not 1 January to 31 December, the data must be provided for the relevant financial-year periods. On request, the contracting authority may require a register certificate or documents proving turnover. The tender must comply with the procurement documents, and any equivalence must be explained and supported by evidence.
