Compliance requirements

The bidder must confirm the mandatory exclusion grounds in the tender passport, including convictions for participation in a criminal organisation, corruption, fraud and other listed criminal offences. If an exclusion ground applies, the bidder may provide evidence of self-cleaning, where allowed by the procurement rules or the tender documents. The machine-readable notice did not include the full list of exclusion grounds; the exact grounds must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must submit a bid that complies with the technical requirements in Annex 1. The bidder must also provide the manufacturer’s technical datasheet and/or user manual, maintenance plans for the warranty and post-warranty periods, and proof of the manufacturer’s or authorised representative’s representation rights. The offered devices must have CE marking and comply with Regulation (EU) 2017/745; declarations of conformity, and where applicable certificates or copies, must be submitted. The bidder must have two maintenance engineers or maintenance technicians employed or otherwise engaged for the whole contract period, trained by the manufacturer to install, commission, maintain and repair the offered device. For joint bids, an authorised representative and a joint-bid power of attorney with joint and several liability confirmation must be submitted. The bidder must also submit the application form, the required declarations on international sanctions and subcontractors/suppliers, and a brief statement on trade secrets or confirm that the bid contains none.
