Compliance requirements
The tender documents include mandatory exclusion grounds. The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor persons authorised to represent, decide for or control the bidder, have been finally convicted within the last five years for offences such as participation in a criminal organisation, corruption, fraud and other listed serious offences. If an exclusion ground exists, the bidder may need to show self-cleaning measures where allowed. The machine-readable notice did not include the full list in a concise form; the exact exclusion grounds must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have a maintenance engineer or maintenance technician employed by, or otherwise contractually engaged for, the bidder for the entire contract period. This person must have manufacturer training for installing, commissioning, maintaining and repairing the offered device. The bidder must submit a copy of the certificate proving this training together with the tender. The bidder must also provide the manufacturer’s technical data sheet and/or user manual, maintenance plans for the warranty and post-warranty periods, and proof of the right to sell and maintain the offered device. The offered devices must have CE marking and comply with Regulation (EU) 2017/745. The bidder must submit declarations of conformity and, where applicable, certificates or copies. If the machine-readable notice did not include any further precise qualification requirements, they must be checked in the official tender documents.
