Compliance requirements

The bidder must confirm the usual exclusion grounds: participation in a criminal organisation, corruption, fraud and the other statutory exclusion grounds listed in the ESPD. If any ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not include all precise exclusion grounds; the remaining grounds must be checked in the ESPD and the tender documents.

Qualification criteria and exclusion grounds

The bidder must have completed at least one street lighting construction or repair contract in the last 36 months, with a value of at least EUR 50,000 excluding VAT. The work may have started earlier, but it must have been accepted within that 36-month period. To prove this, the bidder must provide the contract subject, procurement reference number, client and contact details, the period of performance, and the value excluding VAT; on request by the contracting authority, a confirmation letter from the client that the contract was performed properly. The tender must comply with all tender document requirements, conditional tenders are not allowed, and the required price form must be submitted. In a joint tender, an authorised representative must be appointed. The bidder must confirm that it does not use a subcontractor who would have to be replaced under Section 122(7) of the Public Procurement Act, and that the offered solution complies with the requirements or is equivalent. The machine-readable notice did not include other precise qualification or compliance requirements; these must be checked in the tender documents.
