Compliance requirements

The bidder must confirm that neither it nor its management or authorised representatives have been convicted within the last five years of participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, or offences related to the commission of a terrorist act or terrorist activity. The same exclusion grounds also apply to first-tier subcontractors during contract performance. If an exclusion ground exists, the bidder may submit a description of self-cleaning measures and evidence where permitted. The bidder must also confirm that it does not use a subcontractor that would have to be replaced under Section 122(7) of the Estonian Public Procurement Act.

Qualification criteria and exclusion grounds

The bidder must have performed at least 1 public road construction contract within the 60 months preceding the publication date of the contract notice, with at least 5,000 m2 of the top layer of asphalt surfacing laid per contract. In the ESPD, the bidder must provide the contract details, including the area of the top asphalt layer laid, the contract period, the client and contact person details, and, in the case of a public procurement, the reference numbers. Upon the contracting authority’s request, the successful bidder must provide confirmation from the other contracting party that the contract was performed properly. The bidder must have a quality management system in the field of construction works that meets at least ISO 9001 requirements or equivalent requirements. If the system is not certified, the bidder must provide a description of the in-house quality management system or another document proving equivalence. The tender must comply with the procurement documents and, where necessary, equivalence must be explained and supporting evidence attached. If the bidder relies on the resources of another undertaking, that undertaking’s consent and ESPD must be submitted. In the case of a joint tender, an authorised representative must be appointed. The bidder must confirm that the tender does not contain prohibited information marked as trade secret and that it will provide the contracting authority, no later than the start of contract performance, with the names, contact details and legal representative details of all known subcontractors.
