Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or paying wages below the statutory rate; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security arrears; and situations where awarding the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must also confirm that none of these exclusion grounds apply. The bidder must confirm that it has reviewed the rules and instructions published on the contracting authority’s website.

Qualification criteria and exclusion grounds

If the bidder is not the manufacturer of the offered tyres, it must submit a copy of the manufacturer’s original power of attorney authorising distribution of the tyres in Estonia. If the bidder is the manufacturer, this document is not required. The bid must comply with all tender documents, and conditional bids are not allowed. The bidder must also confirm the delivery time, ETRMA membership of the offered tyres, and a warranty of at least 12 months. The machine-readable notice did not include any more precise qualification or suitability requirements; these must be checked in the tender documents.
