Compliance requirements

The contracting authority excludes a bidder if mandatory exclusion grounds apply, including convictions of the bidder or its management/representation bodies for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; enabling employment of a foreign national staying in the country illegally or violating conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate; illegal use of child labour or human trafficking; or outstanding tax, duty or environmental charge debts, or social security contribution debts under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if the bidder has submitted false information about compliance with qualification requirements or failed to submit requested additional documents. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties with the client representative’s contact details, and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were properly performed, unless the contracting authority can obtain the information from public or its own databases without significant cost. The team must include a person responsible for electrical work with valid A-competence or a qualification corresponding to at least level 6 under the Vocational Professions Act, who holds the relevant proof at the time of submission and is entered in Elektrilevi’s partner portal before the deadline for tenders. There must also be a person appointed as responsible for the work operation, entered in the partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must comply with the procurement documents and include the completed price table, with all unit price fields filled in. If the bidder does not join the contracting authority’s factoring programme, the standard payment term applies according to the contract value. The bidder must also take into account the V178 operating procedure guide when preparing the tender. If business secrets are declared, the bidder must explain and justify them.
