Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against it, and that it has no tax debt or social security contribution debt. The bidder must also confirm that the average salary of its employees during the reference period exceeded 70% of the average salary in the relevant sector, and that it is not a related person to the beneficiary’s technical consultant. The average salary must be evidenced by an extract from the Tax and Customs Board or, for a foreign bidder, by evidence from an equivalent competent authority.
Qualification criteria and exclusion grounds
The bidder must be registered in the Economic Activities Register under the activity of construction with the activity types general construction, indoor climate system, and internal or associated water supply or sewerage system. When carrying out electrical works, the bidder must also have a notification under the activity of electrical works for the construction, including installation, of an electrical installation. The registration requirement does not apply to a foreign bidder, but equivalent competence must be proven. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT; in a joint tender, it is sufficient if at least one joint bidder meets this requirement on its own. The bidder must be able to provide a performance-period security amounting to 5% of the contract value by the contract date or within 10 calendar days after signature; the security may be a bank or financial institution guarantee or a deposit into the beneficiary’s or a notary’s account. Within the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value excluding VAT. The equivalent project must involve the construction, extension or full reconstruction of a building and include at least load-bearing and external envelope works, heat-recovery ventilation, and heating system construction or reconstruction. Proof must be provided by the number of the occupancy notice or occupancy permit in the building register, or by a copy of the handover-acceptance certificate signed by the client and contractor. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a competent person for electrical works; for each role, the name and professional certificate number must be provided. The project manager must have at least a level 6 construction engineer qualification or a level 6 construction manager qualification, the site manager must have a level 5 construction foreman qualification, the ventilation and heating systems specialist must have the relevant level 6 qualification or construction manager qualification, and the water supply and sewerage systems specialist must have the relevant level 6 qualification or construction manager qualification.
