Compliance requirements
The bidder must confirm that neither it nor the members of its management, governing or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking. It must also confirm that the exclusion ground is not still applicable. If an exclusion ground exists, the bidder may submit self-cleaning measures where permitted. The bidder must also confirm that it will not use a subcontractor in contract performance if that subcontractor would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
For Lot 1, the bidder must demonstrate technical and professional capacity by showing at least one properly completed public road construction contract from the 60 months preceding the start of the procurement, under which at least 1,600 m² of the top layer of asphalt concrete was installed. As evidence, the contracting authority may require a client confirmation of proper performance and information on the contract completion deadline and the area of the installed pavement. If the bidder relies on the resources of another entity, it must provide the necessary details about that entity and, where required, the other entity’s consent. To submit a tender, the bidder must complete the HD IV-1 or HD IV-2 price schedule, depending on the lot, and submit it as an Excel file. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
