Compliance requirements

The tender documents include the standard exclusion grounds under the Public Procurement Act, including participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds. The bidder or its representatives must not have relevant final convictions, unless the notice or tender documents allow self-cleaning and the bidder provides the required evidence. The bidder must also provide the names and personal identification codes of authorised persons who are not visible in the commercial register, or confirm that such persons do not exist. The notice also requires confirmation that the offered goods are not subject to international sanctions and that the bidder does not involve prohibited Russian-linked subcontractors or suppliers for more than 10% of the contract value.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment, where such registration is required by law. For an Estonian bidder, this means registration in the Estonian commercial register. The bidder’s average net turnover for the last three completed financial years must be at least EUR 190,000 per financial year for the period 01/01/2023–31/12/2025. Joint bidders may combine turnover figures. The successful bidder must submit extracts from the three latest annual reports showing net turnover, if this information is not freely available to the contracting authority from public databases. For technical capacity, the bidder must have properly performed at least one sales contract for an unmanned aerial vehicle or spectrometer set similar to the subject of the procurement within the 36 months preceding the start of the procurement, with a value of at least EUR 65,000 excluding VAT. If this cannot be verified from public databases, the bidder must provide a buyer’s or client’s confirmation of the contract value and performance period. The ESPD also requires the names and personal identification codes of authorised persons, or confirmation that no such persons exist.
