Compliance requirements
The bidder must confirm that none of the exclusion grounds under subsection 95(1) and subsection 95(4.1) of the Public Procurement Act apply. These include, in plain language, convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or underpayment below the statutory wage; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security contribution debts; and situations where the contract would breach international sanctions. The contracting authority may also exclude a bidder with local tax arrears in the contracting authority’s place of establishment, or in a joint procurement in the place of establishment of any joint contracting authority.
Qualification criteria and exclusion grounds
The bidder or its subcontractor must have submitted a business activity notice in the Register of Economic Activities (MTR) for the field of heritage conservation, with the exact classification “conservation and restoration of a structure located on a monument or world heritage site”, or hold an equivalent registration or permit under the law of the country of establishment. If the bidder or subcontractor is not established in Estonia, a certificate from the competent authority of the country of establishment confirming the registration or permit must be submitted. Suitability may also be demonstrated by submitting the competence certificate of the specialist carrying out the works. The bidder must also provide a list of contracts for similar works carried out during the 60 months before the start of the procurement. Similar works are conservation and restoration works on protected ruins, and at least 2 such works must be shown. For each reference, the bidder must provide the client, contact person, dates of performance and contact details, and if possible the procurement reference number.
