Compliance requirements
The bidder must not be subject to the exclusion grounds set out in § 95(1) points 1–5 and § 95(4) point 12 of the Public Procurement Act. The bidder must confirm in the public procurement register that these exclusion grounds do not apply. If the company has other persons with authority to represent, make decisions on behalf of, or control the company who are not visible from the commercial register card, their name and personal identification code must be provided, or a confirmation that no such persons exist.
Qualification criteria and exclusion grounds
The bidder’s total turnover from all business activities in each of the last three completed financial years must be at least EUR 800,000 per year. If the bidder relies on the resources of another undertaking, the consent of that undertaking must be submitted and the relevant documents must be attached if needed. In the case of a joint bid, information must be provided on the size and nature of the part of the contract to be performed by each joint bidder. The tender must comply with the tender documents, and conditional tenders are not allowed. In the case of a joint bid, an authorised representative must be appointed and a joint bidders’ power of attorney must be attached. The bidder must submit a draft data processing agreement that complies with the technical specification and the draft framework agreement and shows the categories of data subjects and personal data processed, the purpose of processing and the scope of processing. A 24/7/365 ServiceDesk must also be provided, and its contact details must be submitted. The tender must also meet the required specifications in equivalent form where applicable, and evidence of equivalence must be attached if needed.
