Compliance requirements
As an exclusion ground, tenderers originating from third countries are excluded from the procedure. A third country means a country that is not a Member State of the European Union, a country of the European Economic Area, a party to the WTO Government Procurement Agreement, or a country with which the EU has concluded a reciprocal free trade agreement covering public procurement. The tenderer must state its country of origin, meaning the country where the company is registered.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. For tender compliance, the bidder must submit the price in the required structure, complete the technical requirements form, attach the technical specifications and, if necessary, drawings. The bidder must also confirm that the tender complies with all tender document conditions, that no conditional tenders are submitted, and that the payment schedule, contractual penalty terms, response times and onsite support deadlines, and funding-related conditions are accepted. If equivalence is relied on, it must be explained and supporting evidence must be attached. In a joint tender, a power of attorney for the joint representative must be provided. The warranty period must be at least 12 months from acceptance of the works and must not depend on a separate maintenance contract.
