Compliance requirements
The exclusion grounds are set out in the ESPD and include standard criminal conviction grounds such as participation in a criminal organisation, corruption and fraud. The bidder must also confirm that none of the other exclusion grounds listed in the ESPD apply and may, where relevant, provide a description of self-cleaning measures and supporting evidence. If an exclusion ground exists, it must be checked whether remediation is allowed under the tender documents and the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder’s total turnover for the last completed financial year must be at least EUR 20,000, and this must be declared in the ESPD. As regards technical and professional ability, the bidder must prove that it has provided maintenance services for at least one similar object during the last 36 months; a list of at least one contract must be submitted together with the contract value, signing dates and the contact details of the other contracting party. The person responsible for the site must hold a valid professional certificate of either ‘property maintenance master level 5’ or ‘maintenance manager level 6’, or an equivalent qualification, and the bid must include that person’s name and certificate number. Before preparing the bid, site inspection is mandatory; a bidder that has not inspected the site will be rejected without review. The bid must also confirm that it complies with the tender documents, that no conditional bid has been submitted, that a power of attorney is included in the case of a joint bid, that any business secret has been justified where applicable, that the required detailed descriptions of works and services with prices have been submitted, and that the required confirmations regarding sanctions and subcontractors have been given.
