Compliance requirements
The bidder must not be subject to any exclusion ground under Section 95(1) of the Public Procurement Act. This includes convictions for participation in a criminal organisation, corruption, fraud, a terrorist offence or other terrorist activity, money laundering or terrorist financing, illegal use of child labour or human trafficking. The bidder must also have no tax debt and must not breach sanctions. If the tender is submitted together with a foreign company, documents confirming the absence of exclusion grounds must also be provided for that company and for the persons who have the right to represent or manage it. The contracting authority may request additional evidence if the information cannot be checked in public registers.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 3,000,000 excluding VAT, including at least EUR 1,000,000 in each year. If the bidder is not registered in Estonia or if the data cannot be verified from public sources, extracts from annual reports or other evidence must be submitted on request. The bidder may rely on the capacities of another entity, but then a written confirmation from that entity must be provided covering the absence of exclusion grounds, consent to reliance, participation in contract performance and joint liability. As a technical capability requirement, the bidder must have properly performed within the last 60 months at least one substation renovation contract for a 110 kV or higher substation with design services, or one relay protection and automation renovation contract for a 110 kV or higher substation with design services. The contract value must be at least EUR 600,000 excluding VAT, and at least EUR 600,000 must have been paid to the bidder under that contract. If needed, the contracting authority may request the client’s confirmation or other evidence. The contracting authority also requires a completed financing schedule, team CVs, technical questionnaires, a price table and drawings.
