Compliance requirements
The contracting authority will exclude a bidder or applicant if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent, decide for, or control the bidder, has been convicted of participation in a criminal organisation, breach of the duty of integrity, corruption, fraud, a terrorist offence or other terrorist activity, incitement, aiding or attempted commission of such offences, money laundering, or terrorist financing; if such a person has been convicted of enabling the employment of a foreign national staying in the country without legal basis or of violating the conditions for employing a foreign national in Estonia, including payment of wages below the statutory wage rate; if such a person has been convicted of illegal use of child labour or trafficking in human beings; if the bidder has tax, duty or environmental charge arrears within the meaning of the Taxation Act, or tax or social security contribution arrears under the law of its country of establishment; or if entering into the contract would breach an international sanction or a sanction of the Government of the Republic within the meaning of the International Sanctions Act.
The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have an average annual turnover of at least EUR 35,000 in the period 1 January 2023 to 31 December 2025. To prove this, the bidder must submit a free-form statement describing compliance with the requirement and attach a balance sheet signed by the bidder’s legal representative.
The bidder must name an authorised representative who will represent the bidder and provide clarifications if needed, as well as the bidder’s responsible representative during contract performance (the contractor’s project manager).
The bidder, or a joint bidder, must prove that during the last three years (1 January 2023 to 31 December 2025) it has provided works similar to the contract subject. Similar work means road construction supervision services. The bidder must provide information on at least two contracts under which road construction and/or reconstruction supervision services were provided, and the supervision must have covered at least 100 metres of asphalt-surfaced national road. If the bidder relies on a subcontractor’s references, the bidder must show in the tender that the person with the relevant experience will personally perform that part of the contract.
The bidder’s team must include key persons with the following qualifications, and the bidder must submit the team on Form 2: a construction supervision team leader with at least a level 7 certified road engineer qualification, specialisation in road construction and maintenance, and the competence of supervision or an equivalent qualification in the country of establishment; and a road construction supervision specialist with at least the same level 7 certified road engineer qualification, specialisation in road construction and maintenance, and the competence of supervision or an equivalent qualification in the country of establishment. The roles of team leader and road construction supervision specialist may be combined if one person meets both sets of competence requirements.
