Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, use of child labour or other forms of human trafficking, participation in a criminal organisation, commission of a terrorist act or offences related to terrorist activity, or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may in certain cases submit evidence of self-cleaning measures. It must also be confirmed that no subcontractor subject to replacement is used in performing the contract and that subcontractors or suppliers linked to the Russian Federation are not used for more than 10% of the contract value.
Qualification criteria and exclusion grounds
The bidder must prove technical and professional capability with at least one previous construction contract completed within the last 60 months. The required reference is that the bidder, as main contractor or as a subcontractor carrying out and coordinating all construction works, has either fully built or fully reconstructed at least 30 km of drainage ditches in a land improvement system, or fully renewed or maintained at least 60 km of such ditches, or built at least 30 earth dams during restoration works aimed at restoring the water regime of bogs or mires. If the bidder relies on the capacities of another company, the details and consent of that company must be provided. To confirm compliance, the bidder must also confirm that the tender complies with the procurement documents, that no conditional tender is submitted, that in a joint tender the joint tenderers' power of attorney has been attached, and that environmental requirements are met. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the procurement documents.
