Compliance requirements
The machine-readable notice includes the standard mandatory exclusion grounds: convictions for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, terrorist offences, and related criminal convictions. The bidder may be asked to confirm these grounds and, where allowed, to describe self-cleaning measures and provide supporting evidence. The notice also mentions that a first-tier subcontractor is checked at contract performance stage and that the bidder confirms it will not use a subcontractor who would have to be replaced under the relevant law.
Qualification criteria and exclusion grounds
The bidder or joint bidder must have at least one site manager responsible for the construction works, with at least the qualification of certified road engineer, level 7. The bidder must provide the person’s first and last name, professional qualification and certificate number in the ESPD. On request, the bidder must submit a copy of the responsible person’s certificate and a signed confirmation that the person agrees to act as the responsible person for performance of the contract. The bidder must also have properly completed at least 3 similar construction contracts in the 60 months before the start of the procurement. Similar works are construction, expansion and/or reconstruction works for roads under code 21100, performed as the main contractor. The bidder must list the contracts in the ESPD together with the contract partner names, contact details, project address and contract period; if the contracts were awarded through procurement, the procurement reference number must also be given.
