Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2). This means, among other things, that the bidder must not be bankrupt or in liquidation, its business must not be suspended, and it must not have tax, fee, environmental charge, social security contribution or similar debts. The bidder must also confirm that its employees’ average salary during the reference period was above 70% of the average salary for the same period in the relevant sector, and must provide an extract from the Tax and Customs Board or, for a foreign bidder, equivalent evidence from a competent authority. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. In a joint tender, the exclusion grounds are checked for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must have submitted a business activity notice in the Estonian Register of Economic Activities under the activity area ‘Construction’ covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a business activity notice under the activity area ‘Electrical works’ covering construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent competence must be proven. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT; in a joint tender, turnover may not be aggregated, and it is sufficient if at least one joint bidder meets the requirement alone. The bidder must have carried out at least one equivalent construction project within the last 60 months, with a value of at least half of the estimated contract value excluding VAT. The equivalent project must have been the erection, extension or full reconstruction of a building as the main contractor and must have included at least construction or reconstruction of the load-bearing and external envelope structures, mechanical ventilation with heat recovery, and the heating system. For the project, the bidder must provide the project name, time, value, project type and evidence such as a use notice, occupancy permit or handover-acceptance report. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist and, where relevant, a person competent for electrical works; for each role, the name and professional or competence certificate number must be provided. The bidder must also confirm that the tender complies with the procurement documents, use the required tender form, attach a power of attorney in the case of a joint tender, provide a power of attorney if the tender is submitted by an authorised representative, indicate any business secrets, accept the equivalence rule and be ready to provide a performance security of 5% of the contract value no later than the contract date or within 10 calendar days after contract signature.
