Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1)(1–3 and 5) of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that its business has not been suspended, and that it has no tax debt or social security contribution debt. The bidder must also confirm that its employees’ average salary during the reference period was above 70% of the sector average for the same period and provide an extract from the Tax and Customs Board or an equivalent certificate from the competent foreign authority. In addition, the bidder must confirm that it is not a related party to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must have submitted a notice in the Register of Economic Activities for the activity of construction covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a notice for electrical works covering the construction, including installation, of an electrical installation. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided where relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The bidder must have carried out at least one equivalent construction project within the last 60 months, with a value of at least half of the estimated contract value excluding VAT; the project had to involve the erection, extension or full reconstruction of a building as the main contractor and include at least the construction or reconstruction of load-bearing structures and external envelope elements, forced ventilation with heat recovery, and a heating system. Evidence must include the project description, timing and value, plus a reference to the building register notice/use permit number or a copy of the handover-acceptance certificate. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence; for each person, the name and certificate or competence number must be provided. The bidder must also accept the 5% performance security condition and submit the bid on the form required in the tender documents. If the bid is joint or submitted by an authorised representative, the relevant powers of attorney must be attached. The machine-readable notice did not include precise quality management and environmental management requirements; these must be checked in the tender documents.
