Compliance requirements

Mandatory exclusion grounds: the contracting authority will exclude a bidder if the bidder, or a member of its management, governing or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, financing of terrorism, enabling illegal employment, illegal use of child labour or trafficking in human beings. Exclusion also applies if the bidder has tax, fee or environmental charge arrears, or tax or social security contribution arrears, and if the bidder or a member of its management body is subject to an international sanction, unless concluding the contract would not breach that sanction. The bidder must confirm that none of these grounds apply. Voluntary exclusion grounds include breaches of environmental, social or labour law obligations, bankruptcy or liquidation, professional misconduct, anti-competitive agreements, conflicts of interest, serious breach of a previous contract, false information, attempts to influence the contracting authority or unlawfully obtain confidential information, tax offences, and situations where the bidder is not legally allowed to submit a tender. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years must be at least EUR 300,000. An extract from the financial statements for the last three completed financial years must be submitted, showing the net turnover; for a legal entity registered in Estonia, this is not required if the data are publicly available to the contracting authority from a register. If the financial year does not coincide with the calendar year, the turnover requirement applies to the last three completed financial years. At least 6 months must have passed since the end of the latest completed financial year by the tender submission date. During the 60 months before the start of the procurement, the bidder must have properly performed at least 3 similar electrical construction contracts, at least one of which had a value of at least EUR 80,000 excluding VAT. A list of contracts must be submitted, including performance periods, client contact details and procurement reference numbers; the contracting authority may request evidence of proper performance. To submit a tender, the bidder must have a worker with valid switching rights, a person responsible for work operations, and a person managing electrical works with valid A-level competence or at least level 6 qualification; these persons must be entered in Elektrilevi’s partner portal before the opening of tenders. The tender must include the price table and the names and contact details of the contract signatory and the contact person; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must confirm that the tender complies with the tender documents and that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus.
