Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act apply, and that it is not bankrupt or in liquidation, its business is not suspended, and it has no tax debt or social security contribution debt. The bidder must also confirm that its employees’ average salary during the reference period was above 70% of the average salary in the relevant sector for the same period, and must provide an extract from the Tax and Customs Board or an equivalent certificate from the competent authority in the bidder’s country of establishment. In addition, the bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must have submitted a notice in the Commercial Register under the activity area ‘Construction’ covering general construction, indoor climate systems, and building internal or adjacent water supply or sewerage systems. If electrical works are to be performed, the bidder must also have a notice under the activity area ‘Electrical works’ for the construction, including installation, of an electrical installation. The registration requirement does not apply to a foreign bidder, but such bidder must prove equivalent competence if necessary.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint tender, turnover cannot be aggregated to meet this requirement; it is sufficient if at least one joint bidder meets it on its own.
Within the last 60 months, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project must have involved the construction, extension or full-building reconstruction of a building as the main contractor and must have included at least the construction or reconstruction of the building’s load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a heating system. Proof of completion must be provided by the number of the occupancy notice or occupancy permit in the building register, or by a copy of the handover-acceptance certificate signed by the client and contractor.
The team must include a project manager with at least a Level 6 construction engineer qualification specialising in building construction or a Level 6 construction manager qualification specialising in general construction. The team must also include a site manager with at least a Level 5 construction foreman qualification specialising in general construction works. In addition, the team must include a ventilation and heating systems specialist with at least the relevant Level 6 qualification or equivalent competence, and a water supply and sewerage systems specialist with at least the relevant Level 6 qualification or equivalent competence. If electrical works are included, a person with at least a Class B competence certificate or a Level 6 electrical engineer qualification in consumer electrical installations must also be involved. The name and professional certificate number of each required person must be provided, and they must be engaged in the performance of the works.
